1. General
1.1 We reserve the right to change these terms and conditions at any time. If any such changes will take effect from when they are posted on the website and it is your responsibility to read the terms and conditions on each occasion that you use this website. Your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
1.2 If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use this website.
1.3 Wholesale customers must order every season, both Spring/Summer and Autumn/Winter to keep their account with Powder open. If a season passes then Powder have the right to close the account and open another account in the area. Every season Powder has several ‘ranges’. Wholesale customers must order a minimum of £200 per range. If a range is not ordered from then Powder reserves the right to sell this range / these ranges to another retailer.
1.4 Wholesale customers agree not to sell/promote Powder products on Amazon or Ebay or any affiliated sites. Sales on your own websites are permitted.
2. Order Process
2.1 All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions. We reserve the right to cancel or change any order after submission.
3. Delivery
Delivery charges and estimated timescales are specified when you place an order. We make every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Powder shall be under no liability for any delay or failure to deliver the products within estimated timescales.
4. Payment
4.1 We will refund any payment made from your card in the unlikely event that goods are unavailable or if we are unable to fulfill your order. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible.
4.2 Retail orders can be made via credit or debit card, Paypal or Klarna, subject to status.
Wholesale orders can be paid via credit or debit card or Paypal at time of ordering, or via a pre-arranged 30 day credit account. Please contact us for more details or to apply.
4.3 All retail prices include VAT (where applicable) at the applicable current rates but exclude delivery charges. Retail customers out with the UK/NI may have to pay duties/taxes to the delivery courier in advance of receiving their order, except customers in the USA, whose orders will be delivered with duties and taxes paid. A fee of £8/€10 will be deducted from any refund made in the event of refusal to pay and the goods being returned to our warehouse.
All wholesale prices exclude VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated. Wholesale customers out with the UK/NI may have to pay duties/taxes to the delivery courier in advance of receiving their order, except where delivery is to the USA, where orders are delivered with duties and taxes paid. A handling fee of £40/€50 will be charged where a wholesale order is returned because of refusal to pay the courier the charges resulting in the goods being returned to our warehouse.
4.4 Only one discount code/coupon can be used at any one time for retail customers, and no discount codes can be used on our wholesale website
4.5 Klarna's Pay in 3 / Pay in 30 days are unregulated credit agreements. Borrowing more than you can afford or paying late may negatively impact your financial status and ability to obtain credit. 18+, UK residents only. Subject to status. Late fees may apply. Ts&Cs apply.
5. Returns, Cancellations and Substitutions
5.1 Retail customers - You have 28 days from receiving your purchases to return them for a refund or exchange. Orders cannot be cancelled once confirmed and paid for by you, but you can still return the goods within 28 days if they are unwanted without giving a reason. We do not offer a free returns service, any costs incurred to return unwanted goods are payable by you.
5.2 All sizes, measurements and colour replication on images are as accurate as possible but there may be some variation.

The content of this website (including without limitation any text, video, audio, audio-visual materials and graphics) may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without our prior written consent, except as stated below.

7.2 Subject to Section 7.1 above, Powder will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind (whether express or implied statutory or otherwise) regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server from which it is made available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website Powder will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and Powder accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
7.3 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
7.4. Powder will take every step possible to ensure accurate prices are shown on the site. We reserve the right to change pricing at any time until the order has been confirmed when your order is dispatched. Acceptance or acknowledgement of your payment does not confirm your order. This refers to Wholesale orders and prices ONLY.
